Terms of Service

These Terms govern your use of aimarche.com and every order placed through it. By browsing the site or buying from it you accept them, together with our Privacy Policy, Shipping Policy and Refund and Returns Policy. If any part of them does not suit you, please do not use the site.

1. Who you are dealing with

Aimarche is the trading name of LAYSON TAVERN LLC, based in CINCINNATI, OH. We sell Market Kitchen Goods through this online shop and nowhere else. Nothing on this site should be read as an offer from any other business.

2. Who may order

You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order. You agree that the name, address, email and payment details you give us are accurate and yours to use. Orders that look fraudulent, or that we cannot verify, may be cancelled and refunded without further explanation.

3. Your account

If you create an account, the login details are yours to protect and anything done through the account is treated as done by you. Tell us at support@aimarche.com as soon as you suspect someone else has access, and we will help you secure it.

4. Products, descriptions and availability

We describe each product using the specifications, materials and measurements provided for that item. Colours vary between screens, and a measurement taken by hand can carry a small tolerance. We may change, restock, discontinue or withdraw any product at any time without notice, and we are not obliged to keep selling something you bought before.

5. Prices, tax and errors

Prices are shown in US Dollars (USD) and do not include sales tax unless stated. The full total, including tax, is displayed at checkout before you confirm. Prices may change at any time, though a change never affects an order already accepted. If a price or a product description is obviously wrong through a technical or human error, we may cancel the affected order and refund it in full rather than be held to the mistake.

6. Orders and acceptance

Your order is an offer to buy. Our confirmation email acknowledges that we received it; the contract forms when we dispatch the goods. We may decline or limit an order, for example where stock has run out, an address cannot be delivered to, or the quantity suggests resale.

7. Payment

We accept Shop Pay, Visa, Mastercard, American Express, Discover, Diners Club, Elo, JCB, and UnionPay, processed through Shopify Payments over an encrypted checkout. Payment is taken when the order is placed. There are no hidden fees: every charge is shown before you confirm.

8. Shipping

We ship within the United States only, to all 50 states, using one free standard service with no minimum order. International shipping and expedited delivery are not offered. Processing and transit times, tracking and lost-parcel handling are set out in full in our Shipping Policy, which forms part of these Terms.

9. Cancellations

To cancel, write to support@aimarche.com as quickly as you can. We will stop an order that has not yet been processed or handed to the carrier. Once it has shipped, cancellation is no longer possible and the Refund and Returns Policy applies instead.

10. Returns and refunds

Returns are accepted for manufacturing defects, damage in transit and wrong items received, within 30 days of delivery. Change of mind is not a ground for return. The conditions, the 72-hour damage window, the evidence we need and the refund timings are set out in the Refund and Returns Policy, which also forms part of these Terms.

11. Intellectual property

The site and its contents, including text, product descriptions, photographs, page layouts, graphics and the marks of Aimarche, are owned by or licensed to LAYSON TAVERN LLC and are protected by copyright, trademark and other intellectual property laws. You may view and print pages for your own use in connection with an order. You may not copy, republish, scrape, resell or adapt any part of the site for any other purpose without our prior written consent.

12. What you agree not to do

• Use the site for anything unlawful or fraudulent.
• Interfere with the operation or security of the site, or probe it for weaknesses.
• Scrape, harvest or bulk-copy content, prices or images by any automated means.
• Upload malicious code, or attempt to access accounts, orders or systems that are not yours.
• Impersonate another person or misrepresent your connection with anyone.

13. Disclaimer of warranties

The site is provided on an as-is and as-available basis. We work to keep it accurate and running, but we do not warrant that it will be uninterrupted, error-free, free of harmful components, or that every description is complete. Products carry whatever warranty the applicable law gives them and nothing more is implied by these Terms.

14. Limitation of liability

To the fullest extent the law permits, Aimarche and LAYSON TAVERN LLC are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or from any product bought through it, including loss of profit, revenue, data or goodwill. Where liability cannot be excluded, it is limited to the amount you paid for the order in question. Nothing here limits liability for fraud, or for anything else that cannot lawfully be limited.

15. Indemnity

You agree to indemnify and hold harmless LAYSON TAVERN LLC, its officers and its staff against claims, losses, liabilities and reasonable legal costs arising from your breach of these Terms, your misuse of the site, or your infringement of somebody else's rights.

16. Privacy

Your use of the site is also governed by our Privacy Policy, which explains what we collect, why we hold it, who we share it with, and the rights you can exercise, including those of California residents.

17. Governing law

These Terms and any dispute arising out of them or out of your use of the site are governed by the laws of the State of Ohio and of the United States, without regard to conflict-of-law rules. Any proceedings shall be brought in the courts located in the State of Ohio.

18. Changes to these Terms

We may update these Terms from time to time. The current version always sits on this page with its effective date, and using the site after a change means you accept the revised version. If a change matters to an order you have already placed, the version in force when you ordered is the one that applies.

19. Severability and entire agreement

If any clause is found unenforceable, the rest stays in force. These Terms, with the policies they refer to, are the entire agreement between you and us about the site and supersede anything said elsewhere.
